L’articolo analizza la Direttiva (UE) 2017/1371 in materia di tutela penale degli interessi finanziari UE, mettendola a confronto sia con la Convenzione PIF del 1995 e i suoi Protocolli del 1996 e 1997 sia con la Proposta di Direttiva 2012/363 della Commissione UE. Dal confronto emerge, in particolare, come la Direttiva, se costituisce un notevole progresso rispetto al sistema convenzionale pre-vigente, finisce invece per deludere le attese create dalla ben più coraggiosa proposta della Commissione. The author focuses on the European Union and the domestic legislative framework related to the definition of “active farmer”, underlining its critical points and its ambiguities. The author proposes some indications on the reasons of the failure of the model of active farmer introduced by EU legislation in order to make European Union action more efficient, with a view to containing expenditure in the agricultural sector. In this work the theme of the conference held in Palermo on June 15-16, 2018 on "Common Agricultural Policy and Protection of the Financial Interests of the Union" is introduced. Once the regulatory framework of reference has been identified, some of the regulatory gaps have been identified that currently do not make the objective of protecting the Union's financial interests fully implement the measures envisaged by the CAP.
